Designs which are part of the federal design database are in all black and white, with no color, no shading, and no grey. When we search a design/graphic/logo, we treat the design the same way. If you submit a trademark to be searched with color, shading or grey in it, we will remove those elements to arrive at the proper type of image for trademark purposes. If you submit your design/graphic/logo via electronic file we can accept most common graphic file types and make the necessary changes to the file to enable a search.
When you receive a search report from us, you are also entitled to consult with us regarding your search report results. We will be happy to explain or clarify the search results for you and help you come to an opinion about the potential registrability of the searched mark. Please note: Most European Community countries continue to maintain a separate national trademark registry which is independent of the OHIM. This is where most older marks, registered before the creation of the European Community, will be found. At present, none of our search packages cover individual national registries of European countries, except for Great Britain. Plus, we do not search the records of any European countries which are not members of the European Community. Similarly, most if not all of the signatory countries to the Madrid Agreement or the Madrid Protocol maintain a separate national trademark registry which is independent of the WIPO. These national registries are not included in a Madrid Protocol (WIPO) search.
