TERMS AND CONDITIONS - Trademark Searches & Trademark Watching
  • All search reports are available by email (in .PDF format), in hardcopy, or both, at your option - all for the same price! Hardcopy shipment within the U.S. is available by priority mail at no cost. Hardcopy shipment via Federal Express is available within the U.S. or internationally for an extra charge. Note: Trademark watching reports will normally be sent only in hardcopy unless other arrangements are made in advance.

  • All trademark searches other than design/graphic/logo searches are text-based searches including up to 2 key words. Longer phrases may be submitted, but in that event the search results will focus on word combinations rather than single instances of any word. When there are only one or two key words, the results include a search of spelling variations, phonetic equivalents and, when relevant, individual word syllables. In any case, our search results always include similar marks, not merely exact matches.

  • "Actual copies" only refers to search results obtained from the U. S. Patent and Trademark Office, or the U.S. Copyright Office. All other search results are obtained from electronic databases.

  • A Normal turnaround time means that your search request will be completed within 3 business days (5 business days for international searches) and the search report will be sent to you by U.S. priority mail within the U.S, or regular mail to Canada (mail service not available elsewhere). Or, you can receive overnight shipment for an additional $30 per search order within the U.S. or $60 per search order outside the U.S.

  • A Rush turnaround time means that your search request will be completed within 1 business day (3 business days for international searches) of our receipt of the request. Hardcopy shipping options are the same as for Normal turnaround. A rush order must be received by us by 3:00 p.m. (Eastern Time) to guarantee completion by the next business day.

  • Any search cancelled by you after we have begun work is subject to a minimum 50% cancellation fee, depending on the extent of completion. We take your order seriously, and when you say "rush," we begin immediately. For that reason, rush orders are non-cancellable.
Designs which are part of the federal design database are in all black and white, with no color, no shading, and no grey. When we search a design/graphic/logo, we treat the design the same way. If you submit a trademark to be searched with color, shading or grey in it, we will remove those elements to arrive at the proper type of image for trademark purposes. If you submit your design/graphic/logo via electronic file we can accept most common graphic file types and make the necessary changes to the file to enable a search.

When you receive a search report from us, you are also entitled to consult with us regarding your search report results. We will be happy to explain or clarify the search results for you and help you come to an opinion about the potential registrability of the searched mark. Please note: Most European Community countries continue to maintain a separate national trademark registry which is independent of the OHIM. This is where most older marks, registered before the creation of the European Community, will be found. At present, none of our search packages cover individual national registries of European countries, except for Great Britain. Plus, we do not search the records of any European countries which are not members of the European Community. Similarly, most if not all of the signatory countries to the Madrid Agreement or the Madrid Protocol maintain a separate national trademark registry which is independent of the WIPO. These national registries are not included in a Madrid Protocol (WIPO) search.

All trademark searches and watching services are conducted on our behalf by Government Liaison Services, an experienced search firm located in the Washington, D.C. metro area.
